We’re prepared for any contingency. Victory means a Humpbot cameo; defeat means I get tanked on hard liquor in the middle of the day. It’s win/win, really. The boss has already done a quickie round-up of stories this morning predicting the bill’s demise. John Hawkins’s Senate source lends his voice to the chorus:

To begin with, my source said he is guardedly optimistic that the bill will fail the 2nd cloture vote tomorrow. That is because he thinks that some of the senators who voted for cloture on Tuesday were doing so because they were being “senatorial” by allowing a debate. But, that only goes so far, and everyone realizes at this point that the Thursday vote is the final vote on amnesty as far as the base is concerned. In other words, a “yes” on cloture is a “yes” to amnesty.

At that point, I asked about the “fool the yahoos” maneuver. Will there be senators voting “yes” on cloture and then voting against the final bill and hoping that they can avoid being tagged as supporting amnesty? He said that because of all the attention this issue has gotten, the base isn’t going to be fooled and that anyone who does that will just have to hope that his election isn’t close enough that thousands conservatives sitting at home can swing it the other way.

McCain’s Iowa campaign chairman told WaPo yesterday he wished the issue of immigration had never come to the floor. As for St. John’s crony-in-chief, he’s featured prominently in the Times’s story this morning about senators being threatened by nutjobs angry over the bill. See-Dub will clue you in to the agenda behind the piece if you haven’t guessed already, but here’s your quote of the day from the man who once derided amnesty opponents as “bigots” before a crowd of swooning La Raza members:

“One of the requirements of public service in modern America is dealing with a few voices that are full of hate,” Mr. Graham said. “And our discourse and the way we politic, the way we engage each other, brings that out.”

It’s bringing something out: according to freshman Blue Dog Jon Tester, the feedback he’s getting from constituents is more overwhelmingly opposed on this issue than it is on Iraq, where public opposition currently hovers in the mid- to high-60s.

Updates will be flying fast and furious in an hour or so. I’ll do my best to liveblog the vote, although on Tuesday they didn’t repeat each senator’s vote after calling his/her name so it may not be possible. While you wait, read John Shadegg’s nightmare scenario at NRO about the various loopholes built into the bill that would let illegals caught while sneaking across the border nonetheless obtain legal status. Oh, and read this piece at Politico, which is comic in its adulation of Ted Kennedy even by normal media standards.

Humpbot waits in the wings, wondering if it’s his time to shine. Exit question: Pelosi and the gang deserve a pay raise, don’t you think?

Update: Here’s a no we weren’t counting on — Ensign has flipped. Don’t fear the reaper!

Update: They’re trying to flip Thad Cochran the other way now. If my vote tally last night was right, then we don’t need him.

Update: This must be one of those “voices of hate” Lindsey Graham was wringing his hands about. This debate was Godwinned weeks ago; might as well keep it up to the bitter end.

How many times does Teddy need to be told “close the borders first” before he grasps that that’s the alternative?

Update: Reid’s taken abuse, Bush has taken abuse, McCain and Graham and Kyl and Martinez have taken abuse enough for a lifetime, but one guy has stayed miraculously clean even though he’s sat idly by and let this sham take its course despite the uproar from his base and the pleas from Sessions et al. Save a little bile for him.

Update: How absurd has it gotten?

In case you didn’t catch this, the opponents of shamnesty are rushing through their statements because the Grand Schemers have only given them 10 minutes to speak. The shamnesty senators will get the rest of the hour to talk. “Typical,” says Session, of the way this debate has gone. And so starkly absurd. You’ve got the pro-amnesty senators on the floor now all bleating about how debate shouldn’t be ended…having just limited their opponents’ time to a measly 10 minutes.

Update: Here we go. Standby for liveblog totals.

First run-through is 19-21. Webb voted no! I think most of them deliberately haven’t voted yet, though, so that they can see what the first totals look like and then vote accordingly.

25-30 now! Humpbot is warming up…

31-38! TWO MORE.

I count fully 53 no’s. We did it.

Update: Here’s the roll. Gonna go do the cross-check to see who switched.

Update: The yes/no switchers were Bingaman, Bond, Brown, Brownback, Burr, Coleman, Collins, Domenici, Ensign, Harkin, McConnell, Murkowski, Ben Nelson, Pryor, Stevens, Voinovich(!), Warner, and Webb. Republicans are in boldfaced. I guess you can thank Sean Hannity for shaming Voinovich into flipping.

It’s worth going back and looking at the order in which they voted, to see who held back and waited to gauge how the vote was going before casting his/her ballot. I’ll bet Mitch McConnell was one of them.

Update: Well, well. Brownback initially voted yes — and then switched to no when he realized he was going to lose. Disgraceful.

Drudge links to The Hill, which quotes Graham as follows:

“Remember this day if you vote ‘no,’” Graham said, adding that this bill would not come back in its current form and it is “as good as it gets.”

Why is he so sure of himself on this? Is he banking on the Democrats winning a larger majority in the Congress next year? Almost nothing would have guaranteed that more than Republicans supporting this POS bill!

Why not, I don’t know, go back to conservative values, the kind which actually resonate with the voters, and WIN BACK THE EFFING CONGRESS and then crafting some truly conservative legislation to deal with this problem rather than SELLING OUT THE COUNTRY?

Kensington on June 28, 2007 at 1:28 PM

Until everyone on this forum calls and writes like they did for this bill for our troops you are the same hypocrites you claim are in office today.

I will say it over an over until you get it. you are lying if you say you are. So while your writing that email or phone call add the troops to it. Pat yourselves on the back for a job not yet done. Not even close.

tomas on June 28, 2007 at 1:03 PM

Ok tomas, lets get to the bottom of this. Lets say we all pick up the phone and call right now. We don’t mention shamnesty but we do as you say and say, “I support the troops.” At that point we accomplished what? The person on the other end of the line says, “Thank you sir, Sen Kennedy supports the troops as well.”

So, thats what will happen if we do what you are telling us to do litterally. Now, when you say “support the troops” what exactly do you mean by that? Be specific. Do you mean, “I believe that President Bush’s strategy for Iraq and Afghanistan is exactly correct and we should continue to do exactly what we are doing?” Or do you mean, “I believe that President Bush’s strategy for Iraq and Afghanistan is flawed and we must change course in order to support the troops properly?”

In order to make progress on something you must have an ultimate goal. You must have a definite direction as opposed to bland, tired and generic talking points. Now I’m not asking you this question to be a wise guy. I really want to know exactly where you stand on this and where exactly it is you are encouraging us to stand. So, specifically, what is the destination you are hoping to reach? What ultimate goal do you envision? How shall we best “support the troops?” And most importantly how can you see through the computer screen and know what we have or have not already done?

Unfortunately I’m also one of the cubicle dwellers who have been out of touch this morning with no opportunity to catch up on the news. From what I see here my ‘esteemed’ Senator
(Spector) has shown himself to be a fool/tool once again. He is an embarrassment for sure. Colt’s Fan is exactly right….. Pat Toomey should have gotten stronger support than he did since Spector seems to be confused as to who his actual constituents even are! I feel that I should offer apologies for Spector and little Bob Casey but neither of them was my fault. Where are you, Rick?
We overcame today —- at least for awhile.

all due respect but you have no idea what you are talking about. If you want to talk about being a part of the surge, Which I take is a double entendre about the Iraq surge and this current grassroots surge then lets compare efforts cause I got 23 months worth in the first and a few emails in the latter.

The question I pose is what have you done?

Supplied ample amounts of empty rhetoric and halfbaked accusations.

Who sounds like a senator?

I emailed a congressman’s office asking if it was DEAD for sure….
They replied:

“Dead yes, but I’m sure they’ll bring it up again, but not until the next legislative session. I even heard that they might wait until they get a Dem for president. That should be a hard warning. The work doesn’t stop. In fact it is just beginning.”

I think that maybe what tomas was trying to say was that we should put this kind of passion, effort and willpower (i.e. calls and letters to legislators, etc) into demanding support for the military and their present effort (the surge), and maybe we could get similar results.

And if even if he wasn’t saying that, I am! =)

That’s going to be a problem. The bill never came to a vote. They were just voting to let the bill be voted on, and they’ll say they would have voted against it. They never attacked their opponents, they just laid back and kept their mouths shut. I don’t even think the issue came up in their debates, did it? Clinton and Obama come off looking a lot better than McCain, who attacked the integrity of his opponents. I don’t think there’s anything that can be used against Clinton or Obabma from this mess. Obabma actually was very skilled at playing both sides of the fence. No, this bill hurt some Republicans (McCain, Brownback). Other Republicans came off looking pretty good (Tank, Hunter, FRED!).

jaime on June 28, 2007 at 1:46 PM

Voting to allow the bill to proceed by ending debate were 33 Democrats, 12 Republicans and independent Joe Lieberman, Conn. Voting to block the bill by not limiting debate were 37 Republicans, 15 Democrats and independent Bernard Sanders, Vt. Tim Johnson, D-S.D., did not vote.

Jamie, I agree with your loser list on the Repulican side - the assessment on Obama/Clinton is only true if the electorate is totally naive, which this has proven that it’s not. Look everyone understood that a vote for cloture was a vote for amnesty. Add into the very liberal amendments offered by Obama and voted for in favor of clinton. take all the tough amendments voted against by Obama and Clinto and you have a killer issue in the race. It is not hard to pin this to the Democrats 33 democrates voted for this bill.

unseen on June 28, 2007 at 1:50 PM

OT - all - please get off that single-threded horse or mantra of “build the fence”. The number one issue is the super-magnet - employers who hire illegal skilled and unskilled labor. Yes, the fence is important, or the protection of the border by any means. However, until this law of punishing employers is not put into effect, no means, and no fence will stopp this invasion. Which bring up another point. Please quit calling it anything but an invasion. As the media and politicians establish ‘talking points’ so can we. And we are better at it, and see how effective!

I’m so happy this is happening now, all of it: the liberal congress, the conservative near-divorce, the soul-searching for what really matters. If we don’t follow our laws and our principles, what are we teaching the rotw? Drink the water while we get stupefied on wine?

Entelechy on June 28, 2007 at 1:23 PM

Entelechy, first off I love reading your posts. You remind me a bit of Peggy Noonan in the sense that you are classy, substantive and have a unique ability to step back and see the big picture with a greater clarity then most can. I get the sense that you are a genuinely kind and pleasant person. Now enough of that and let me address what you said. I think the reason many of us are pushing for the fence is because it is part of (but not all of) the more important point you were talking about which is enforceing the laws and particularly against those who hire illegals. Stopping the bleeding at the border is a law that needs to be enforced and we have seen the success of the double fence in the San Diego region. We hear McCain and Lott talk about how a fence won’t work and what we need is high tech cameras and other technology and that just sounds like a scam. At this point we pretty much know that whatever they are for in regards to this issue we should probably be against and visa versa. We know fences do work. We have seen them work. We know it has worked well for Israel. The fence is also something we can see. It is something that a robot can walk up to and hump. We know that only two miles have been built after our Senators lied to us and told us it would be built. We can see the effort they have put into it and it has been remarkably poor. We know if done properly it can be a cheap way to stop the bleeding while we work out other law enforcement issues within the borders. Most importantly we know if our elected officials are unwilling to take that step then they can’t really be trusted. We can see with the number of feet built just how little we can afford to trust our elected officials. Sometimes a robot just needs somthing to hump.

I’m no expert on these things, but Clinton nor Obama stuck their neck out on this. Obama submitted a couple of innocouos ammendments, and he’ll say he was trying to improve a bill no one liked very much. I think he even voted against bringing the zombie back this last time (first coture vote this round). Clinton was almost completely silent. As far as I know, she just voted to bring the bill up for a vote (voted for cloture). I think they acted very well for the sound-bite primary campaign. They’ll be teflon on this during the Dumocrat primaries, it’ll be a non-issue. And during the general, Tank and Hunter won’t be there, so only Fred! has the upper hand. McCain was too abusive to his opponents. Mitt and Rudy have both supported amnesty before, until their “enlightenment.” I think Fred! is the only Repub that has a chance to use the immigration issue as a club in the general.

This is a win for the Immigrants of America and those who want to be Immigrants to America.

And by Immigrants I mean of course the true, legal, immigrants who have gone through the long, legal process and background checks and interviews and medical checks ad-nausium for the privledge to immigrant to this nation.

I still remember the long wait in getting my fiancee (now wonderful wife and mother of my two children) over here. The endless calls to the american embassy in Manila only to get the same canned response every time: “you have to wait”. The waiting and wondering ‘whats wrong?’ which they refused to answer.

Even got my useless Senator involved - not that they did anything but recite the same tired bullshit the embassy said.

Perhaps I should have told the Senator (or Bush) my fiancee wanted to be an illegal alien. She probably would have taken personal interest and force the viaa through come hell or high water.

(and that was with a Fiancee visa - about the fastest ones you can get….).

Hopefully this rotten bill will stay dead this time.

Dear Zetterson, thank you for the kind note. Let’s just objectively state that I’m very pleasant, except for when I’m treaded on. At that point one wouldn’t want to be on the other side. Nice toughy :)

There is nothing I disagree with you, on the above stated (on the fence). I live in San Diego and with that which this brings, good, bad, et all.

My point is that in all this, the employers are getting a break. Hardly anyone, most of us here too, don’t mention it, except to say “respect all our current laws”. This is great but too general, and too easy to discard.

Let’s try to agree on this - the two major items to focus on are:

1. Protect our borders, real and virtual, and
2. Enforce the legal hiring laws on the books

Then we remove the mantra “what do you want to do with the 12 million already here?” The magnet is simply too attractive and powerful compared to the lack of deterrents. It also makes us appear to function like a 3rd world country, where laws are just pro forma.

This bill would encourage that many more to come, no matter what happens with however tight or tall a fence.

Btw. - financial figures out this morning - Los Angeles spent for social services for illegals, healthcare costs not included, 30 million in May, 2007, alone.

We agree. Regards,

the fence is way more than just a fence. Its says we are fed up with ALL the law breaking. NO More Illegal Aliens or the hiring of illegals!
We’ve been promised a fence for decades. It IS WRITTEN IN LAW. It IS FUNDED.
A fence says this is AMERICA, a nation of laws. It is everything to us right now. Then we can work on the companies, but if there is no fence, the millions south of the border KNOW its just not really a problem. Come on in.
Businesses say ” well , if they were serious, there would be a fence”. Hire ‘em anyway.

A fence tangible, it will work, it is needed, we must build it.

ENFORCE EVERY LAW and BUILD the FENCE, NOW!

Martinez (R-FL)
McCain (R-AZ)
Snowe (R-ME)

Clinton (D_NY)
Obama (D-IL)

The Dirty-Dozen need to be challenged by real (R)epublicans in the next election.

Is it possible to force the politicians to enforce the current laws about immigration. Which leads to; are there any repercussions against government officials for not enforcing certain laws. This must fit under the equal protection clause, right?

JackS on June 28, 2007 at 2:15 PM

We don’t need a bill. These laws are already on the books. So are legal immigration laws. Just enacting these two, and all other laws we have, would take care of most of the problems. Then special worker programs or others could be addressed individually.

Entelechy on June 28, 2007 at 2:15 PM

As a side note. Anyone notice that the stock market is not tanking? If this bill was soooo important to the agribus, construction, real estate, homebuilders etc., shouldn’t we have a SELLOFF on these stocks. Hmmm and yet we don’t…strange that. Maybe this was more than a bill for Big Bis….something to think about.

unseen on June 28, 2007 at 2:17 PM

Let’s try to agree on this - the two major items to focus on are:

1. Protect our borders, real and virtual, and
2. Enforce the legal hiring laws on the books
Agreed! Can we just submit that as our bill?

Zetterson on June 28, 2007 at 2:12 PM

You guys are making progress. Here are some additions:

We need to do something to stop the wrong interpretation of the 14th Amendment which is encouraging more and more anchor babies.

We need to punish VISA over-stays.

ColtsFan on June 28, 2007 at 2:18 PM

Big Question will Bush pardon all 12 million before leaving office?

unseen on June 28, 2007 at 2:18 PM

Entelechy on June 28, 2007 at 2:15 PM

Exactly, just enforce the laws that are on the books. The refuse refuge cities?…cut fed funding to them.
See how simple that is?

right2bright on June 28, 2007 at 2:19 PM

And as a footnote, very disappointed in Leiberman. Very.

Enforce the law and prime the exodus pump. Fines for employer enablers, a cab ride from the free treatment at hospital, illegal truent officers, internal enforcement.

LET THE EXODUS BEGIN

Looks like you’re headed to a 1000 comment thread!! Good for you…
I’m glad this bill died. Good news for our representative republic. The will of the people prevail.

For now…. until they think we’re not paying attention.

I suspect this may have been the last hurrah for Bush. Kennedy and Reid won’t be as cozy with him in September when they try to block troop funding.

We need to remember to keep calling the US Senators over the next couple of days.

We need to be very quick to thank the Senators who rose up in defense of the Constitution, Sessions, DeMint, etc.

We also need to remind Lugar (R-Indiana), Gregg of New Hampsire, Casey, Democrat of PA, Graham-amnesty, Kyl that we will not forget.

Bad Candy on June 28, 2007 at 2:30 PM

Wow. Could this be the first 1000 comments thread?

Slublog on June 28, 2007 at 2:30 PM

And Entelechy is right, getting the wall built is just the start, we have to demand current laws are enforced internally and expand on them if need be.

Particularly enforcement on businesses. Once Unamused and PRCal get their program running, we can find out who got paid what by businesses that hire illegals. Should be fun, and maybe, maybe we can shame them into enforcement finally.

“Our future, the next generation’s future, depends on our marshalling these same forces together to begin to make improvements in immigration policy, one piece at a time, starting tomorrow.”

What we now need to do is to insure that the existing laws ON THE BOOKS (1986/2006) are enforced to protect this cherised nation.
PETITIONS PETITIONS PETITIONS

It’s a wonderful day it is. This bad bill is down and robots are up.

And it’s only Thursday. My weekend looks brighter and brighter.

Congrats to all that applied pressure. Let’s make this post 1000+

Kini on June 28, 2007 at 2:36 PM

Non-enforcement seems to harken back to Douglas’ “Freeport Doctrine” Speech. What is required for their to be a penalty is people that care enough to enforce it.

apostle26 on June 28, 2007 at 2:36 PM

Kyl, Martinez, Graham-amnesty, Hagel?

One common denominator:

They are all die-hard “McCain for Prez” supporters, even at the cost of stomping on the Constitution.

We have work to do.

ColtsFan on June 28, 2007 at 2:37 PM

Gregg in NH has already received several phone calls from me today. And speaking of NH, I think NH has some issues. Check out elected Rep Lily Mesa. This woman was elected in NH! Not AZ or New Mexico or CA. NH!! Everybody needs to check this out to get a sense of the problems we face:

The only question I have is who wrote this article for her because SHE CAN’T SPEAK ENGLISH!! Wow does that burn me up.

So when is round three?

Kennedy hasn’t been that PO’d since he ran out of ice on the yacht.

“Oh Juan, err bring me errr some errr ice and make it errr pronto, or errr you’ll be back in Mehico before sunset”

Hening on June 28, 2007 at 2:43 PM

We need to apply pressure on our House representatives now for them to bring forward a fence and enforcement bill forward!

Especially focus on having ICE deport the illegals in our prisons and jails! As they are released ICE picks them up, has the paperwork already started or completed and deports them! How simply is that!

Excellent first step!

SSG Fuzzy on June 28, 2007 at 2:45 PM

Ok….one more to help get us over 1000……

How are the Spanish language stations handling the story?
Anyone?

We have one. Bush signed it in 2006. Congress needs to make the President ENFORCE the DAMN LAW. If he doesn’t impeach his ass. THAT is why the IMPEACHMENT CLAUSE is in the constitution.

unseen on June 28, 2007 at 2:48 PM

If President Bush has any last vestige of political instinct left in him, he will reach out the the American people RIGHT NOW, and commit to the Law Enforcement duties of his office.

Some do understand that but some hear those who have called and are calling the victorious opponents to this bill racists and biggots and thats what they believe. Chertoff, Graham, President Bush, Linda Chavez et all have caused more damage to their party then they understand. Its people who believe the things that they said that hurt the Republicans. All of the names mentioned above along with many more cannot be replaced soon enough so as to ensure that the voices representing us actually do just that - represent us.
