We’re shooting at a moving target here but best estimates are that opponents are within six votes or so of killing this monster in its crib when the first cloture vote comes to the floor tomorrow. John Hawkins’s Senate source said last week that the first vote is the time to get it done, otherwise it’ll pick up momentum and force a do-or-die second cloture a few days later that will determine the bill’s fate. Here’s the list of undecideds, again per the Corner:

Bond (R-Mo.), Bingaman (D-N.M.), Burr (R-N.C.), Boxer (D-Calif.), Cochran (R-Miss.), Conrad (D-N.D.), Ensign (R-Nev.), Levin (D-Mich.), Gregg (R-N.H.), Nelson (D-Neb.), Hatch (R-Utah), Webb (D-Va.)

George Voinovich might be in play, too. One of our commenters claims to have called Ben Nelson’s office and been told that he’ll vote yes on cloture but no on the final up-or-down vote itself. That’s a transparent sham designed to give him political cover so that he can plausibly claim later that he voted “against” the bill. The critical vote is cloture, since it requires 60 to proceed; the final vote requires a simple majority, which the amnesty faction probably already has. They don’t need his vote for that but they do need it for cloture, and he’s planning on giving it to them. Here are the Senate phone numbers; even if, like me, you’re too apathetic normally to practice direct democracy, this is a special occasion. If you call Nelson’s office, you might care to mention this result from today’s Rasmussen survey, which, let’s hope to god, will prove to be the final “killer poll” needed to euthanize this sucker:

Among the public, there is a bi-partisan lack of enthusiasm for the Senate bill. It is supported by 22% of Republicans, 23% of Democrats, and 22% of those not affiliated with either major party. It is opposed by 52% of Republicans, 50% of Democrats, and 48% of unaffiliateds.

The closer we get to 41 “no” votes, the easier it may be to shame the other wafflers into joining us. The House GOP is threatening to hit Bush where he lives over this. Start calling.

Update: One down, four to six to go.

Update: Martin from MVRWC says he called Kit Bond’s office and was told Bond will vote yes on cloture if his amendment removing the amnesty provision from the bill is accepted. I think that means the second cloture vote, not the first one tomorrow. Presumably Bond’s voting yes on that, then.

Update: I’ve got a bad feeling about this.

Our date with destiny is Tuesday morning (tomorrow) at 11:30.

That is the schedule for dealing with two unrelated bills, including the cloture vote to allow the S. 1639 Kennedy/Bush Comprehensive Amnesty Bill back on the Senate floor.

But those last five are proving to be extremely difficult votes to get. Constituency pressure is proving to be about the only thing that works — and it has worked remarkably well in places like Georgia, Texas and even beginning to work in Michigan.

Update: A Senate “insider” who spoke to Rich Lowry says he’s suddenly feeling pessimistic.

Update: Got an e-mail from a reporter friend who says Bond, Cochran, Bingaman, and of course Ben Nelson are all voting for cloture.

It’s going to pass.

I know where one of my Senators (Kay Baley) is on this cloture vote. I have e-mailed her office several times on the issue and always get a response.
But cannot get a response from the other Senator (Cornyn)

Does anyone know where he stands?

My understanding is Cornyn is on our side on this, but I’m not 100%.

My senators are worthless, particularly Specter. I’m no use on my own state reps, but there are other places to contact and maybe influence.

Well, here’s a copy of the email I fired off to Senator Bond. Hopefully others will contact him with similar thoughts:

Dear Senator,

As Missouri constituent who has been following the recent immigration debates quite closely, and who understand very well what is on the table vis-a-vis the up coming cloture vote, I strongly urge you to vote against it.

This entire amnesty affair is an absolute fiasco. It’s dishonest, and it’s certainly not in tune with what the majority of polled Americans think. According to the most recent Rassmussen Report, a meager 22% of people polled actually support the immigration bill.

I am in favor of the government creating a guest worker program, and I recognize the need for a bolstered labor force in our country. However, the immigration bill in is current form will only serve to make the illegal immigration problem a thousand times worse. At the very least, it will open gaping holes in our national security system. What will happen when terrorists take advantage of this and start homicide-bombing cafes and delis in our own land after crossing the southern border with little impunity? It could very well happen if the current amnesty plan is passed. It could happen right this minute unless we start enforcing the laws that are already on the books.

The legistration is crap, pure and simple. Please, vote it down. Work with someone who isn’t named Kennedy to craft a piece of well-written, well-thought out, and legal legislation that gets the job. Do not settle for the half-assed garbage being spearheaded by Sen. Kennedy and (sadly for me as a conservative), President Bush. It’s also pretty embarassing that someone as decidedly liberal as Ms. McCaskill is against it, while our honorable conservative senator is not.

I called Burr’s office this morning and told the guy on the phone that a yes on cloture and no on bill won’t fool anyone, and we’ll dump Burr next election if he votes this way.

I just got off the phone with Senator Burr’s office.

Amusingly enough the young lady who answered the phone didn’t know his position on the bill and couldn’t but me in contact with anyone who did.

So I politely asked her to pass along a message that if he voted for it he’d never receive my vote again. She’d heard the same from “a bunch of other people” and couldn’t understand why people were so upset.

Amazing, so I explained it to her in little words why I’m so against this PoS.

One of my Senators is Senor Graham. Sigh. The other one, however, is DeMint and it is my understanding that he is firmly opposed to this Bill.

You know, I moved from NJ to SC 2 years ago and was THRILLED to have Graham and DeMint instead of Lautenberg and Corzine (Senator at the time) as my Senators. Now, not so much. At least in regards to Graham.

I wrote Senator Hatch a week or so ago when HA first had a post about the ‘vote for cloture but against the bill’ sham. I’m not in Utah, but, my big sister is and said I could use her address since she agreed with my position (but was too busy to write). I told him that a vote for cloture would be considered exactly the same as a vote on the bill and he would lose 2 votes (sister & brother-in-law) if he did that.

I got a letter back that actually addressed some of the points I made, but, he doesn’t say whether or not he’s going to vote for cloture.

I appreciated reading your comments regarding our nation’s immigration system and the recent debate over comprehensive immigration reform. I welcome the opportunity to respond.

As you know, the Senate recently considered a comprehensive immigration reform bill (S. 1348) intended to address the many problems that plague our immigration system. The bill was debated in the Senate for two weeks and, on June 7, a motion to end debate on the bill was defeated, preventing a final vote from taking place. I agree with the bill’s proponents that we need a comprehensive approach to fix our immigration problems. However, I voted against the motion to end debate because I couldn’t support the bill as it was written and I did not want to let its sponsors force it through the Senate. It is anticipated that we will again take up this issue in the near future.

When it comes to our immigration policy, the status quo is completely unacceptable. Foremost, we simply must do more to secure our borders and develop capable and workable enforcement practices. I believe an approach that couples increased border security and more efficient workplace enforcement will help to stem the tide of illegal immigrants coming to the United States. This is a particular concern in Utah, especially in Southern Utah, which has become a focal point for various networks specializing in the trafficking and smuggling of illegal drugs and immigrants. I am working to direct more Federal government resources to addressing these problems.

In addition, I believe we must find a fair and lawful way to deal with those that are already in our country illegally. However, I will not support any proposal that I believe amounts to blanket amnesty for all illegal immigrants as that would be unfair to the thousands of people who have waited in line to enter the country through the proper channels. Also, a limited guest worker program must be created for our American – and specifically Utah – businesses in need of foreign workers. Finally, for any immigration system to work, we must distribute visas and green cards in a more fair and efficient way.

The current Senate bill would address a number of these issues. For example, it would impose a series of border security triggers that would have to be met before any new immigration programs could be implemented. This is intended to assure that our borders will be secure before we allow any guest workers to enter the country. In addition, the bill would create a more efficient system for employers to verify the immigration status of their employees. The bill would also impose a merit system and a more extensive criminal background check for those who apply for entry into the United States.

That being said, I continue to have a number of difficulties with this legislation. I hopeful that, as the amendment process moves forward, we can work to improve the provisions of the bill in order to ensure we enact sensible changes to our immigration system. Rest assured that, as the Senate debates this legislation, I will remain committed to enacting substantive reforms that serve our nation’s interests and uphold the rule of law. I will certainly take your comments to heart as this process goes forward.

Just noticed that one of my Senators is actually on the “maybe” list which is a shock because, I thought it was a guarantee that both of my CA senators would be voting yes. I wonder if Boxer’s issue is that the bill is not liberal enough? I suppose, a letter to her to encourage her not to vote for cloture couldn’t hurt.

My Mom’s in Missouri and will write/call Bond some more to let him know how she feels about it.

Hmmm… just struck me…

After rereading the case against the two Border Patrol agents, it struck me that the Border Patrol policy is NOT to pursue anyone trying to run away… its one of the things which came out in the trial…

Now… they want a VIRTUAL fence, which will spot illegals, and then send BP agents to respond… and… pursue them?

I’m screwed with both of my Senators: Martinez wants the piece of crap bill, as does Bill Nelson. I need to move back to TN!

BTW, a nice little old lady I know who lives in central MS informed Trent Lott that (a) she DOES know where Gulfport is; and (b) she will NOT support him in the next election if he votes for cloture and/or for shamnesty (should it get that far). I’m sounding the alarm to everyone I know.

When did illegal immigration become an “emergency”? 911 should have been a call-to- arms, but this administration refused to address the problem at that time.

The only “emergency” I see is that the presidential candidates don’t want to address this in 08. That’s the only urgency about this bill.

I say stall it, let it die and then let’s have a real discussion. Let’s see which of the candidates will pledge “Enforcement First”.

We are a family of conservative Democrats and along with family and friends are doing all we can to help defeat this junk legislation.

The reason the powers at be prefer a virtual fence is they know it is not as effective as a real double layered one.If Mexico,LA RAZA and these type entities thought a double layered fence like the one near San Diego did not work they would be all for building it.

I live in Utah and have spoken to Hatch’s offices three times.
Today the D.C. office took me 20 tries to get through. The person on the other end stated most people are calling about the bill. I told him that cloture is a vote for the bill he said that it wasn’t a given. I told him he knew that was wrong and that they will have the votes to pass this if he bends and allows them to vote on this.

I let him know that many Utahns I know are watching this knowing if he votes for cloture he is voting for this bill.
Before I let him go I made sure to remind him that this will tarnish his image in Utah for good and prove that Senator Hatch is falling to pressure from Bush and not listening to his people.

Just called Sen. Nelson’s office. I was told that he does not support the Shamnesty Bill. When I asked if he would vote for cloture the girl said she did not know. I asked if he intended to let his constituents know what his intentions are. She then said “As a matter of principle Senator Nelson always votes for cloture as he believes all bills deserve an up or down vote.” I told her that that was a cop out. He isn’t fooling anyone with that. I did not vote for him and if he voted for cloture that I would work tirelessly to ensure he is not re-elected again. She the promptly hung up on me. Think I’ll have to call back :)

I just talked to Webb’s DC office. The Senator “has not reached a final decision on the bill because there are so many amendments”. It seems to be a similar line that someone at Ace’s site got from Burr’s office. It sounds as if he’s going to vote for cloture and vote against passage.

I just called (my) Senator Ensign’s office and Pam said that he hasn’t announced his stance for/against cloture yet.

I reminded her in no uncertain, but polite, terms that all those high school seniors who slept through civics class have now learned how to spell “cloture” and know what it means. If he votes for cloture, at least he has his veterinary practice to go back to.

Just called Webb’s office in Roanoke. They said they have had hundreds of calls against the bill and only a handfull that support the bill. They also said the Senator has not made up his mind, but “hopefully he will vote according to the will of the people”. Other than the obvious, I’m rather surprised his office would be stating a position like that if he did not intend to vote against cloture. Cross your fingers and keep dialing!

Senator Burr,
If you vote yes on Cloture, and no on the Amnesty Bill, you will be fooling no one. Your constituents are against this bill, and we know that a vote for cloture IS a vote for this Sham.

If you do this, I and everyone I know will not only vote against you in your next election, but will actively support WHOEVER your opponent may be. That includes liberal democrats, libertarians and independents.

Then call back, do the “*” thing, but then press “2″. TA-DAAA… you get your other Senator! You didn’t really want to ruin your evening by flying into a rage, did you?

According to the CBO’s of the bill, it’ll only reduce the flow of illegal immigration by 25 percent. I haven’t seen that number making the rounds much. Or have I not been paying attention?

I just called Burr’s office, using the convenient Shamnesty Approval Hotline http://michellemalkin.com/2007/05/24/flood-the-amnesty-hotline/

(thank you pro-illegal immigrant groups for making it so convenient). Unfortunately, I was connected with a staffer’s voicemail box and received a message that the mailbox was full. My guess is that it is mostly full of pro-shamnesty voicemails.

I was able to get through earlier and was told something similar as was reported in an update above. I was told that the cloture vote wouldn’t matter and that Burr would vote against the bill unless he was satisfied that the final ‘issues’ were resolved. She didn’t think that (his satisfaction with the outstanding issues) would be resolved.

I told her (and the other staffer I spoke with at the Wilmington office) that any vote for cloture would allow passage of the overall bill, and I would treat it (with my vote) as voting for the overall bill. I hope there is some chance we will get this thing stopped. Otherwise, get out the torches and pitchforks :-)

I just faxed Barbara Mikulski(D) Maryland. She has already voted for cloture in past votes. I am going to get my 2 cents in regardless. I think everyone should contact their Senators any way they can, even if you may think it’s a lost cause. LET THEM KNOW WE ARE NOT HAPPY!!!!!!!!

BTW, Allah, I looked up donors to the potential “no” voters. Not good for us. A chunk of them had between several thousand and several hundred thousand donations from people who benefit from illegals.

I just got off the phone with Senator Burr’s office.

Amusingly enough the young lady who answered the phone didn’t know his position on the bill and couldn’t but me in contact with anyone who did.

So I politely asked her to pass along a message that if he voted for it he’d never receive my vote again. She’d heard the same from “a bunch of other people” and couldn’t understand why people were so upset.

Amazing, so I explained it to her in little words why I’m so against this PoS.

There has to be some sort of immediate, grassroots, systematic pushback if those “no” votes don’t come through. Only problem is so many people have dropped their Republican affiliation already it’s hard to know what there is to fall back on in the way of a visible mass protest. Other than staying home in 2008 (except when it comes to the presidency).

I called Senator Bond’s local office and emailed him telling him that if he supports this immigration bill, I will never volunteer for his campaigns again nor will I vote for him. I just called the Washington office and left a message saying the same. I cannot believe that I even have to do this with Bond. I am totally disgusted.

What is even more bizarre is that the ethically challenged, campaign promise breaker McCaskill is actually voting no. Go figure.
