Amnesty bill cloture vote in progress; Update: Cloture fails, 45-50; Update: Dead?

Cross your fingers.
Update: They’re very close to 41 no votes. Webb, Tester, and Pryor — all Democrats — just voted no.
Update: I’m pretty sure they’ve got 41. But will Reid renege on his threat to shelve it and offer new amendments instead? See the boss’s late update here about FAIR and the super-amendment the amnesty crowd is drafting.
Update: Jon Kyl, the linchpin of the “grand compromise,” just voted no. The vote’s going to fail. The question now is what Reid does.
Update: It failed, 45-50. Reid’s speaking now. He’s shelved it for now but says he’s open to a package of new amendments over the next several weeks to try to pass the bill. It’s dead — for now.
Update: Fox is running the headline, “Immigration bill dies in the Senate.” I’m not so sure…
Update: Reid noted that an unnamed colleague came into his office today and cried over the bill. MM names the prime suspect.
Update (bp): I can’t take much more of Dingy Harry whining on the Senate floor. Especially when he doesn’t know the difference between illegal aliens and lawful citizens. The man is a sad joke.
Update: MM pens the obituary:
As annoying as Reid’s refrain was, he is right: This was the president’s bill. This was the monstrous sham that President Bush tried to ram through the Senate with his pal Teddy Kennedy–subverting the committee process, attempting to cram it in before the Memorial Day holiday, rushing to limit debate, and then complaining about delays. This was the bill President Bush sent conservative-bashing bureaucrats like DHS Secretary Michael Chertoff to peddle on CNN. This was the bill President Bush championed while deriding critics as fearful bigots and running away from building the fence he promised to build.
If the White House thinks conservatives are going to forget whose bill this was and the tactics the White House used in its failed attempt to ram it through Congress, they better think again.
If Lindsay Graham and John McCain think their abominable behavior is going to be forgotten, they better think again.
Update: John Hawkins: “A source in the Senate says this bill is as dead as Stalin and it won’t be becoming back no matter what McConnell is saying on the floor.”
Update: If Hawkins’s source is telling the truth then pin a big gold star on Jim DeMint. Or, as I like to call him, the Anti-Graham:
After the 2nd cloture vote failure at noon on Thursday, Harry Reid could not get unanimous consent to call up amendments to the bill because Jim DeMint refused to give his consent. This was extremely problematic for Reid because he wanted to get in votes on 6 more amendments before the last try at a cloture vote… This essentially killed the entire afternoon that the pro-amnesty side hoped to use to shore up support for the bill.
While DeMint was gumming up the works, the opponents of the bill, including most prominently Jim DeMint, Jeff Sessions, and Tom Coburn, huddled and came up with a list of conservative amendments they wanted considered.
The “Grand Compromise” crowd didn’t want a lot of these amendments to be voted on because either some of the amendments would have been accepted and it would have killed the bill or alternately, they would have had to vote against common sense enforcement measures and made themselves look bad.
Update: The sweet smell of death is in the air…
Democratic leaders were quietly pessimistic. House Democratic Caucus Chairman Rahm Emanuel (D-Ill.) said Bush could count on 175 to 180 House Democrats to support a similar, comprehensive immigration bill, leaving the White House to deliver at least 40 Republicans in a body that has been far more polarized.
“If Bush could not get the votes in the Senate, what was he going to do in the House?” Emanuel asked.
Update: WaPo reveals the wrangling that secured passage of the killer Dorgan amendment last night and ultimately probably doomed the bill. Trent Lott is shocked, shocked (and “ashamed”) to find strategic voting going on:
Dorgan and a GOP ally, Sen. Bob Corker (Tenn.), looked to Republicans who had voted against the sunset amendment two weeks ago but who were known to have qualms about the bill itself. The target list included five senators from states with illegal-immigration problems, or where the issue had a particular potency with conservative voters. Along with DeMint, the list named Sens. Jim Bunning (Ky.), Charles E. Grassley (Iowa), Elizabeth Dole (N.C.) and Mike Enzi (Wyo.). Dole and Enzi face reelection next year.
After conversations with Dorgan and among themselves, four of the five decided to support Dorgan’s late-night second effort. Moments before the vote, Republican leaders succeeded in talking Grassley back to their side.
Update: WaPo reporter Dan Balz mourns the demise of the amnesty craptacular and wonders what it means for our political culture that we can’t come together as a people to support horrible, disastrous policy compromises.

It may be the final nail, but it isn’t driven home yet. We do need to keep driving until the 111th Congress is seated (with hopefully a pro-enforcement President-elect waiting in the wings).

Time to go on the offensive!
The real American Conservatives in the House and the Senate need to kick it up a notch and introduce some legislation that will force the stifled enforcement bureaucracy to wake up and smell the lawbreakers, then ship them home sweet home.
Time to rock!

I am for a bill allowing 40,000 Chinese masons in immediately so they can begin work on the next man-made object visible from space, the Great Wall of America. Once the wall is completed we can have a rational discussion about what to do with the 12M+ people on the wrong side of it.
Shoot, we spent $14B burying 3 miles of highway in Boston. The Great Wall of America would be cheaper and easier than the Big Dig and provide a great benefit to the whole nation.

Hey Amerpundit, a couple of outstandingly hilarious morning radio guys called Walton & Johnson came up with an idea this morning to send lots of little salsa packets from Taco Bell or someplace like that to our representatives.
Not a bad idea, actually. The symbolism fits and concrete little gestures like this, accompanied with a written list of things we’d like done (SECURE OUR DAMNED BORDERS!) would get a lot of attention, I would think.
techno_barbarian on June 8, 2007 at 12:00 AM
WooHoo!
I can’t belive Boxer did the right thing.
Where do we go from here? They aren’t going to stop trying there just going to try to work it another way.
CCRWM on June 8, 2007 at 12:08 AM
I think it’s a creative idea, but logistically it might be difficult. Unless we send the salsa packets via shipping box, when the letter goes through the sorter, it would most likely pop.
amerpundit on June 8, 2007 at 12:08 AM
“They’re” going to try to work it another way…hate when I do that…
CCRWM on June 8, 2007 at 12:09 AM
Jeff Sessions too.
Jim DeMint did damn good.
Bad Candy on June 8, 2007 at 12:20 AM
Yep. But if we used something like sealed and padded CD mailers I think it might work with no problems. Cheap and effective message. Cheaper than shipping bricks, too. ;)
techno_barbarian on June 8, 2007 at 12:24 AM
Nope they won’t stop and we can’t either. The call for a secure border has got to keep going and get even louder or they’ll run this thing through while we’re celebrating our victory. I’ll be willing to talk about what should be done with the criminal aliens already here once the border fence is built and Ramos and Compean are pardoned but until then this is a dead issue. Meanwhile we need to make plans to throw the shamnesty bums out of office and get people who know who they work for in. This could honestly be a big winner in the upcoming elections because there are tons of democrat voters who aren’t happy about this thing either.

The most insightful comment in this entire thread. Maybe in the second term of the next president another bill will be offered up.
Bradky on June 8, 2007 at 12:54 AM
Lunch tomorrow. Go to Taco Bell or someplace like Jack In The Box and order a taco and ask for LOTS of hot sauce, or pick it up from inside. Or go to Sam’s Club or some big discount bulk place and buy a case of salsa packets. Shouldn’t be that expensive at all.
Go to Office Depot or the like and buy some padded CD mailers. Print out your own personal list of prioriety items to which you’d see them attend; throw it in mailer and send them to our reps.
We need to, in no uncertain terms, threaten them with the loss of their jobs unless they:
A) actually listen to us,
B) properly represent us, and
C) actively enforce current legislation which will solve this illegal immigration problem for legal citizens, who are the ones who will actually have to pay for it in every way imaginable.

Now is the time for someone to introduce a bill to build a fence across the entire border, with no provisions adressing immigration of workers of any sort. Put them all on record.
Coyote D. on June 8, 2007 at 2:35 AM
Why do I keep replaying in my head all those Sunday shows when Schumer et al were smugly intoning some variation of “The founding fathers intended the Senate to be the cooling saucer.”
Stephen M on June 8, 2007 at 4:09 AM
Nice sentiment but you will likely be waiting a long time. The problem will be much worse in another five years before it even gets looked at again.
They are already on record and partisans will forgive them in the long run.
Bradky on June 8, 2007 at 7:30 AM
Now we all need to thank our senators that voted against this and demand that they bring a bill to the floor that mandates that the fence be built. We need to keep calling them and demanding the fence because we know their sentiment is that they know best and we have no better plan. If we stop now, they’ll just figure we are a bunch of racists and the next time, they’ll ignore us a pass this pos bill.
csdeven on June 8, 2007 at 7:42 AM
LOL Ya think? And which members of the majority party are going to accept the Republican solution in totality?
Bradky on June 8, 2007 at 7:51 AM
Here’s a thought….
After reading this article, I was reminded of how stupid Bush’s behavior was leading up to the 2006 election. Here’s the specific part that got me…..
Did Bush want the balance of power to shift so he could push through an immigration resolution in an attempt to save his “legacy” because it had become obvious the Iraq war was never going to be resolved to a point that he would be viewed favorable by history?
Was this Roves final attempt at a “Magnificent Bastard” moment?
csdeven on June 8, 2007 at 8:07 AM
McCaskill, Tester (MT), and Mary Landrieu have been a good surprise on this!
SouthernGent on June 8, 2007 at 8:19 AM
Last November, liberals had a strategy to run many conservative Democrats for Congress and then try to trick Americans into believing they had a liberal mandate.
So it’s really funny watching the “moderates” like Webb, McCaskill, and others defy them and the president on immigration.
Some people at RedState are arguing that conservatives are not sufficiently grateful to Bush for things like the Supreme Court justices, the War on Terror, etc. But Michelle Malkin makes much more sense. Bush was the author of this horrible immigration, and we shouldn’t ever forget that. No more “moderate” presidents.
I think he wanted the same legacy he prided himself with in Texas. He was always a “Hissy Fit” Graham/McCain type “moderate” and prided himself with compromising with liberals in Texas. His second term has reeked disdain for conservatives. He didn’t seem at all unhappy that Democrats took over Congress.
januarius on June 8, 2007 at 8:34 AM
I was trying to link to this by Michelle Malkin:
januarius on June 8, 2007 at 8:38 AM
And one of his biggest liabilities (Rumsfield) was a millstone around his neck, and by extension, the republicans necks. But he lets him go the day after.
Perhaps his claim that he kept Rummy around to avoid the appearance of a political ploy, was in all actuality a political ploy in itself?
My heads spinning.
csdeven on June 8, 2007 at 8:42 AM
I don’t think so. I think he is disappointed that when the Repubs had the majority they didn’t have the guts to pass a bill and he truly feels one needs to be passed.
Like him or hate him I think Bush really doesn’t care that much about “his place in history” which in my opinion is a good thing.
Bradky on June 8, 2007 at 8:54 AM

Good Grief tomas, are you just here to flame because you’re mad that you lost the amnesty fight?
Assuming the commenters here don’t support our troops because they were busy trying to defeat this bill clearly demonstrates something about you.
So, look in the mirror and ask yourself if you handled this important debate with a level of maturity that warranted even a single response.
You know, if we cared what you think some of us would be asking for an apology.

I don’t care what you think of me…I’m not important. I’m sure you will try to pass it off as flaming. I hope that makes you feel better.
I don’t think you guys are showing you care as you did with this issue, atleast vocally. Pass me off, but the heart doesn’t lie.
tomas on June 8, 2007 at 11:33 AM
Everything always come back to that doesn’t it with you guys? I am getting tired of the one note symphony coming out of the left. Well they do scream for investigations in between stanzas so I guess in reality it is a two note symphony.
The men and women of the armed forces have their job and they expect and deserve to have those back home cover their backs and take care of business back home in their absence and that is exactly what is being done.
Me I did 22+ years in the Army and I came home to town located in the heart of the south in which half of the signs are in Spanish only. Where I can’t read the billboards because my HS Spanish is fading. A town with street name like Veterans Memorial Highway and there are more Hispanic businesses and non English speaking people who have not a clue what the original name of the street was. A town that is home to a former governor of GA who while his families hardware store is still there it is sandwiched in between 2 other businesses that I have no idea what they do.
I came home to an America where everytime I call a customer service desk I have to select which language to use and the voice on the other end speaks none of those choices.
So you want to go back to the war on Islamic extremeists that is fine, but there are other issues and discussions of a glorified secretary at the CIA ain’t one of them either.
/rant off
LakeRuins on June 8, 2007 at 11:34 AM
That is great…and it is simple to accuse me of being from the left.
What I saw was a great effort of support on all levels for this bill.
I have not seen close to the same for our boys. Think about it.
I’m saddened that they have become second. I never saw conservative leaders or any leaders standing on capitol hill consistently reminding us of this wars importance.
Soldiers are dying because the voices are to quiet. We need to let the world know again that there cause is a great one and that they should be supported. If you attack me for telling the truth…you can all go to hell and back because that is the burden we are putting our soldiers under.
WE aren’t…by god…supporting them as they should and don’t blame liberals or anyone else. You made yourselves heard now do it again or curse be on us all.
tomas on June 8, 2007 at 11:41 AM
Well, I don’t know how long you’ve been around here, but our support for the troops is second to no others. Our support for them is NOT based on what WE want like it is for the selfish traitorous liberals. Our support for our warriors is for on what THEY want. They want to complete their mission. They would feel as if all their sacrifices and those of their battle buddies would be in vain if they were forced out before accomplishing the mission. Another insight into the mind of warriors…..the minute a time table for withdrawal (which means failure and surrender)is announced, every single trooper will be trying not to be the last person killed instead of completing their mission.
You have not made it clear how you think the troops should be supported, so before I go off on your comment, perhaps you’d like to clarify exactly how you think we should be supporting the troops.
csdeven on June 8, 2007 at 12:09 PM
Ya know what? Forget it. This is and amnesty thread, not a support the troops thread. Lets get back on topic.
csdeven on June 8, 2007 at 12:11 PM
They just finished a press conference on C-SPAN. Kennedy, Kyl, Graham and Spector. Graham-” I know where the votes are; we have the votes to get this bill passed”. Kyl-” we can get a few more ammendments in and have this done in a couple of days.”
They still don’t get it, they’re still not listening. I knew they would stay at the back door and just shove harder to get this through. It took less than 24 hours.
Time for that full court press people, or the celebration is already over.
tomk59 on June 8, 2007 at 12:47 PM
I don’t know how else to state this, but you’re accusations that we don’t support the troops as much as we should, is just downright offensive.
Fact is, the amnesty smack-down was a severe blow to your ego but, if you believe in polling trends, it was a HUGE victory for the American people and for America.
I thank God that conservatives used their collective power to send a message that, like most Americans, we want verifiable border enforcement, citizenship background checks, and enforcement of penalties against employers who knowingly hiring illegals. Oh, and lest I forget the most important issue of all… NO AMNESTY!
We want all of these things BEFORE introducing any other legislation dealing with so-called guest worker programs for illegals who are already here.
CliffHanger on June 8, 2007 at 12:49 PM
I hope it is offensive to you…you aren’t as out there on the issue as you are on Immigration…that doesn’t mean you don’t care it means you need to do the same thing.
tomas on June 8, 2007 at 12:56 PM
Funny thing happened earlier this week.
I called my Senators, Cantwell & Murray and when I asked the Cantwell screener what the calls were running (for or against the bill), he refused to tell me. I kept pushing, and he didn’t budge. “We’re not keeping count” (riiiiight….), “People call to tell us, if they want to say what their position is, they can”, (I’m not asking for specific names, I said), “No, I can’t tell you” (Why is it that Kyl & Kennedy can claim to have lots of support for the bill, but I can’t even get that info out of my own Senator, I asked).
The call ended without me ever finding out, although I suppose you could say I gathered the answer from his refusals anyway. Even here, in Washington state, people don’t like it; otherwise he would have been crowing about the support.
linlithgow on June 8, 2007 at 12:57 PM
Oh tomas, who peers into our souls and who can confidently state that because we’re not specifically expressing support for our troops in an amnesty thread – you don’t know how wrong you are.
You were asked a question about how you support our troops but I don’t recall your answer. My guess is you support our troops because you support our President in everything he does and everything he stands for. Is that it? Blind goose-stepping loyalty on every issue and anything less than unquestioning support of Bush is tantamount to treason according to you and jummy?
For the record, and I know others have written the same thing, we do support our troops in many ways. We support our President when he pursues an aggressive offensive strategy against Islamic extremists and terrorists. If we feel he could be a bit more aggressive, we say so but we still support him and our troops.
Again, where do you get off? Because you’re losing the amnesty arguement, you think this line of accusatory screed will win the day?
Maybe it’s just me but I’m guessing that you’re just a flaming, immature attention whore.
CliffHanger on June 8, 2007 at 1:18 PM
Limerick (I think) in essence asked where do we go from here?
I think the thing to do is keep up pressure up; we’re all worried that since they haven’t built the fence to date, they won’t start now. That obviously means, that despite the provisions of S1348, any meagre enforcement in it wouldn’t have been funded either. So we didn’t lose anything.
My hubby and I both told the RNC to sod off; take us off your list… don’t call us, we’ll call you, if you shape up. You can still donate to various Reps and Senators directly, just not fund the Machine. Tell them if they build the fence they’ll see support.
I plan on calling the White House Monday and use the carrot method; tell them the way they can redeem themselves is to start keeping promises by building the fence and hiring more guards. I plan to push this aspect of the battle now, and I think we have a chance of getting some traction.
linlithgow on June 8, 2007 at 1:42 PM
You guys lost by the way you acted…that was my arguement. And if you think you have been as vocal I think you are all lying or insane. It sure isn’t all over the news.
I’ve had a friend die in Iraq so shut up. The only option is victory and you piss on your president in a vile way well beyond what is needed. You won but you lost big time and our soldiers lose big time.
They don’t need to hear about your sick twisted personal feelings on the president…they need support and the reaction on THIS site was and is the wrong one.
I lost you are correct. The support for the President shouldn’t waver even if you hate his guts.
tomas on June 8, 2007 at 1:45 PM
Oh spare me, tomas… you think you’re the only person who’s lost someone in this war? Nobody gets absolute moral authority; not Cindy Sheehan on behalf of the left, and not you.
I refuse to be the goosestepper the left always accuses our side of being. NO politician, for any reason, EVER!! is entitled to or deserves blind loyalty. In this country, we’re supposed to think for ourselves. I support the war on the merits, not because Bush or anyone else tells me to. And I support a strong border and a reasonable immigration policy on the merits as well. Bush is wrong on this issue, and I’m not going to pretend he’s right now or ever.
Laura on June 8, 2007 at 2:04 PM
You guys totally miss the point. You have won your Jihad. Good luck.
tomas on June 8, 2007 at 2:12 PM
Dude! “Maturity” – Google it!
We disagree with Bush on a few important issues and that translates into “hate” and a lack of verocity of support for our troops? Perhaps a few commenters do hate Bush but don’t lump everyone who disagrees with YOU as sufferers of BDS.
I happen to support our President but I don’t agree with his stance on illegal aliens. I admit to be taken aback by his and Chertoff’s “bitch-slapping” comments directed at the base so I understand why folks are angry right now. The vast majority of us are not bigoted, rascist or otherwise mean to minorities. We’re motivated out of a genuine concern for our national security and we simply want our laws enforced and immigration under control. In regards to Hispanics, they’re some of the nicest, sincere, hard-working, and family-friendly people you’ll ever meet.
We love our fellow man. Most of us will welcome immigrants into America to work our factories and our fields – but only in a controlled and legal manner once our borders are more secure.
I’m sorry you lost your friend to the battle in Iraq. Rest assured the vast majority of us hope and pray that our fallen soldiers have not sacrificed in vain. We continue to support nothing less than victory in this war, including a democratic Iraq that can sustain itself.

Screw you, and you can stick that “jihad” remark right where the sun don’t shine. It is totally disrespectful to the troops you claim to support to compare the war they are fighting against real jihadists who would kill and enslave us all with a political disagreement over immigration here at home.
Laura on June 8, 2007 at 2:27 PM
Yes, they would. So don’t help them.
tomas on June 8, 2007 at 2:39 PM
Hey tomas… How do our troops feel about illegal immigration?
Any soldiers reading this blog out there care to answer?
CliffHanger on June 8, 2007 at 2:46 PM
I’d like to hear from some of our soldiers – How do feel about tomas’s expressed support for you?
Or, do you feel those of us who disagree with our President and who want this “immigration reform” bill to die are in some way not showing enough support for you and your mission?
Is it not patriotic to want our borders secured, our existing immigration laws enforced and immigration more effectively controlled?
CliffHanger on June 8, 2007 at 2:51 PM
I want them to win…you are getting in my way.
tomas on June 8, 2007 at 2:52 PM
tomas, you don’t know if we are in your way or not. You have your eyes shut. You are blindly following this nothing president into oblivion while we are moving on to find greener pastures. Be careful on your journey though because its going to be a very lonely one.
Who’s your guy by the way for the ‘08 election? You know that Bush isn’t eligible right?
Zetterson on June 8, 2007 at 3:24 PM
Never mind everything I’ve ever written. Tomas is right.
SUPPORT AMNESTY! SAVE THE TROOPS!
Laura on June 8, 2007 at 3:36 PM
tomas, I am late to this pity party, so help me out. How are those on the other side of this diagreement “helping” the jihadists?
Jaibones on June 8, 2007 at 3:39 PM
I will say it again…support the troops with the same vigor you did this Amnesty Bill. It isn’t hard people.
I’m voting for Rudy.
tomas on June 8, 2007 at 3:44 PM
And I will say it: you’re an arrogant twit for assuming we don’t.
Laura on June 8, 2007 at 3:49 PM
We do.
csdeven on June 8, 2007 at 3:49 PM
Whoa, hold on a second! Nobody supports Bush’s amnesty push and approach to the GWOT like McCain. You sure McCain’s not your man?
Also, did you just call it “this Amnesty Bill”…? Would you like to take back that Freudian slip?
CliffHanger on June 8, 2007 at 3:53 PM
tomas … so, by not supporting Bush on the sham amnesty bill, we’re somehow not supporting the military? This doesn’t make sense. You’re implying that we must support everything Bush does, or else we don’t support the military.
darwin on June 8, 2007 at 3:54 PM
Tomas, the reason we have troops in the first place is because we depend on them for our nations security and the preservation of our way of life. We need to secure the borders and enforce immigration laws for our nation’s security and the preservation of our way of life. So what we are pushing here is a “comprehensive” strategy. Support the troops and drive away anybody in favor of Amnesty and abandoning our nations immigration laws. Hows that?
Zetterson on June 8, 2007 at 3:56 PM
