He’s speaking live now and lowering the boom on Nifong and the accuser. He actually said he believes the kids are innocent, which he didn’t at all need to do, as Ace explains.

Update: Here you go. Money: “We believe that these cases were the result of a tragic rush to accuse and a failure to verify serious allegations. Based on the significant inconsistencies between the evidence and the various accounts given by the accusing witness, we believe these three individuals are innocent of these charges.” Note the line later on, too, about caution and bravado.

Nifong is just another power hungry, say anything, do anything political hack. These students at Duke were just grease for his treads to get reelected. And yes I do hold the black community in the area responsible. He played them like a violin and used their own prejudices to get reelected. Like it or not bigotry and racism are not the exclusive property of any one group of people.

Folks,
I know her name was an open secret for months on the Web, but I’m really concerned by the precedent set by Fox and our own News & Observer (which helped gin up all the hysteria to begin with) of outing her.
Publishing her name strikes me as a punitive act, one that sets a bad precedent.
Real rape victims are going to see her name dragged through the mud, and my fear is that an under-reported crime will become even more under-reported, as legitimate accusers of real rapists will think this could happen to them if the police can’t build a rock-solid case.
Perhaps that is not a logical fear, but deciding to bring rape changes (or not) is an emotional decision, not a logical one.
As for Mangum herself, I fear for her physical safety. I don’t know that anyone will attempt to harm her, but once she see’s her name plastered all over the media, she may attempt to harm herself.
No good will come from how this is being treated.

The Rape Shield law is what empowered her to begin this travesty and allowed Nifong to think that he might get away with it.
Three young men had their lives derailed for over a year and almost destroyed WHEN THEY DID NOTHING ILLEGAL.
No good will come of shielding people that make false accusatons.
One of the most disgusting things to come out of this is that people are more worried about the impact on future potential rape victims than the actual consequences of what was done to these THREE INNOCENT MEN.
I like to believe that the same standards of witness and testimony apply to all crimes and all victims. The Justice System can’t be titled in any groups favor. The law must be blind to gender. Otherwise we get more false prosecutions like this case.
Rape is one of the most horrifying thing that can happen to any human being, but being falsely imprisoned for decades in a hell like maximum security prison when you have done no crime, is worse.

I think the accused Duke players were fearful of their lives when the Black Panther Party came to town and almost started riots at the school against them.
The rape shield law needs to be expanded and protect the accused, as well, until the time comes that it is proven the accused did commit a crime. Far too many people have had their lives ruined on false charges.

So who determines which accusers get outed? Shouldn’t it be black and white (no pun intended? Kobe Bryant’s accuser was outed, now this woman is outed…
If it is 100% certain she lied, she should be prosecuted, which would remove her anonymity. I was attacked by a few black guys years back (not rape, I’m a dude), and in the paper it identified me as a student, not by name. No charges ever came of it. Because no charges came out of it, would it be fair to publish my name? We all know, in this day and age to know one’s name is to know everthing about them, including where they live.
Kobe Bryant’s accuser was threatened with death by several disturbed individuals. Rape shield laws are designed to prevent this type of abuse. Just my opinion, I respectfully disagree with some of you.

In the case where the women lie and knowingly drag the names and lives of innocent men through the mud, you’re damn right I want those women routinely outed. This wasn’t simply a case where there was a lack of evidence to convict, this was a case where the available evidence all pointed to the innocence of the players, yet this (numerous expletives deleted) chose to press forward with this case, be it for malice, greed, or whatever reason. She did so with no regard whatsoever for the lives of the innocent, the damage to race relations in the community, or the damage to the justice system. She could have stopped at anytime, yet she chose to push the case forward, changing her story to fit new facts as they emerged. This was an egregious case of knowingly and falsely accusing someone of rape.
She deserves to be outed and humiliated to the maximum extent possible. God may have mercy on her soul, but she certainly deserves none whatsoever from earthly beings.
And everything I said applies to Nifong as well, many times over, as he had the authority of the legal system behind him and abused it flagrantly. If there is anyone who deserves to be raped and beaten in prison more than he does, I certainly haven’t heard about them.

Secondly, in both cases, the motivation of the accuser was suspect, as were their morals. The worst thing is to use the “rape shield” law to smear and defame people with false accusations of rape. Such accusations are way too serious to level them at someone maliciously.

Apart from Nifong’s malfeasance, and apart from the the criminal laying of a false charge by Mangum (or whatever her name is…she isn’t to be prosecuted anyway), I have another question.
Duke University. They bailed on these guys at the first rumour of trouble. Forget presumption of innocence. Forget their reputations. They suspended them immediately. Mighty big of them to invite them back last January…I honour the guys for not returning.
But, is there any action that can betaken against the University? Do they get their tuition back from last year? What about the year of their lives? The reputation?
Duke University is supposed to have one of the best law schools in the United States….what happened to the “golden thread” that runs through the common law?
Apart from suing Nifong until he squeals, I hope soomeone takes a good strong run at Duke. And if they do, no sealed settlement…I would like it to be made public.

You have the right to face your accuser in a court of law, not the press.
Y’all are right, though, in that rape shield laws as they apply to the media, or even self-imposed media restrictions, usually no longer apply after a case has been dropped.
False accusers, like this woman, ultimately deter women from pressing charges. They should be prosecuted.

I understand what you are saying. I just believe that rape is a crime that is different from all other crimes, in that the majority of victims are afraid/embarrassed to even lodge a complaint. Imagine a scenario where a woman is raped, files a complaint, but it never goes to court. That doesn’t mean a rape did not occur, only that there was not enough evidence to bring it to trial. BTW, I’m not talking about the Duke case! Yes, that does actually happen. Publishing details about these women deter other women from coming forward. I just think rape is a special case where it is better to shield everyone’s identity, unless the “victim” is prosecuted for filing a false report. The accused can still face their accuser in a court of law if it comes to that.

I suggested a way to get back at Duke and “The 88,” yesterday.
The parents of these 3 men should rent as many billboards in the Raleigh/Durham, NC area and post a simple message:
“Duke University, their president, and the following group of instructors rushed to judgement and publicly libeled our sons by wrongfully accusing them of rape.
These people are:
name and title 1, name, etc. 2, name, etc. 3, name, etc. 4, name etc. 5, name etc. 6, name etc. 7, name etc. 8
We, the parents of the defendants call for the immediate firing of these instructors from Duke University.”
Rotate all 88 names through the list, changing the billboard each month. Rent 11 billboards (or as many available) and saturate the county with as many different combinations of names as there are billboards rented.
From my own advertising experience using billboards, they will probably have to sign a contract for a year. But that’s okay, because for 12 months, 11 bill boards will be displaying the names of EVERY ONE of those 88 who PUBLICLY signed that newspaper advertisement.
The billboard’s message is non-slanderous. The 88 made themselves part of the public record with THEIR public document. And there is NOTHING that they can do about it except live every day for the next 12 months knowing that people are reading their name on a billboard that identifies them as a defamer.
This is the downside for those “brave” liberals who think they can publicly attack people with their “truth to power” nonsense and get away with it. These “teachers” can be and should be held accountable for their actions.
And as a finale, file a defamation suit against all 88.

I think she was egged on by the ‘Reverend’ Jesse Jackson, who probably coached her into believing in the payout at the end.
I hope that everyone who should be held accountable for this miscarriage of justice is held accountable – the accuser, Nifong, his DNA Lab co-conspirator, the ‘Reverend’, the Duke faculty that wrongly asserted the boys guilt, and everyone else who piled on at the beginning of this mess. Lots of apologies and LOTS of money should be exchanged.
Watch Duke – it will be interesting how they handle the coach that was fired…

William Teach, as a fellow North Carolinian (Raleigh), I will be happy to pay that little extra in taxes to watch Durham, Duke, Nifong, Mangum and the Duke 88 get their a$$es sued off. But personally..I think that most of the tax burden should come on the backs of the jerkoffs in Durham who elected Nifong and fanned all this racial idiocy. The associate press story on this is ridiculous.
I lost track of how many times they said it brought attention to the privilege of college athletes and the gap between the working blacks and the rich white students in the area.
How did this case highlight any of those things?
The athletes privilege? Their season was canceled. They were indicted on the flimsiest of evidence. Their school suspended them. The faculty and students protested against them (again, all without evidence). What special privilege did these boys have for being on a sports team?
The gap between the working blacks and the rich white students? Well, there was a gap in ethics between the stripper and the college boys, but, I don’t think that’s what they meant.
Plus, the AP story points out how they “don’t name the accuser in sex crime stories”. That’s such a crock. The name of the accuser in a rape case is protected. However, once the accusers story unravels and it’s apparent that she/he was making up stories against innocent people, why do they merit the protection?
This whole thing is such a travesty.

If you can get expulsed from a University for attending a party where a stripper was present, America’s Universities will be pretty empty.
