They have since taken the post down, but here’s where it was.

It wasn’t “satire,” it was a smear. Drudge ought to ring up his lawyer.

Update: There’s a link to a site that captured the “satire” down in the comments. Disgusting.

This happened to me on a theater messageboard when I expressed a conservative opinion. Someone announced that I must be a child molester and should be treated that way. Eventually I was banned after I started dishing the snark back to the lefties.

I think that the author has committed defamation per se. No need to prove economic damages, here. In addition, the test in New York Times v. Sullivan, that the author acted with malice and in reckless disregard for the truth, seems to be a given here.

Of course, the little turd who authored this probably lives in his parent’s basement at age 39, has a go-nowhere-job flipping burgers, and drives a 10 year old clunker.

So, in addition to being a schmuck, he’s probably judgement proof as well.

Never really know until you try. The only way these people are going to realize the seriousness of their actions is when they themselves are threatened with legal action.

The irony is a member of NAMBLA is more than likely to be a liberal and more apt to be a reader of DailyKosTrash. But what do you expect from a group of people who protest the government putting to death a convicted killer one day then attend a pro-choice rally the next. It boggles the mind.

There was no satire in that. Not legally, not logically.

There was a way to do it – however tasteless – and remain satirical. But a straightforward headline, stating a false fact – something that a reasonable person would accept?

Actionable libel. Significant damages. Period.

Also really stupid. At least make it funny. Sheesh. Liberals have no sense of humor.

That’s weird that they took it down now. It was up as a recommended diary for a long time yesterday, even as front-pagers were posting. Surely admin saw it then and allowed it to stay.

It was up at least for 2 hours and 9 minutes according to the above Google cache showing the 347 comments.

Two hours worth of libel air time. And how many people saw this? And reported it as a factual report in their blogs and such?

lol! Try as he might to hide the truth, Kos failed to hide the tags for the post. Even the Democrat Underground is better at covering up their true feelings of their members better than that.
