Report: Charges against Duke lacrosse players could be dismissed tomorrow

Is the glorious, long-awaited news really going to be broken by a guy from Inside Lacrosse magazine?

Perhaps, my friends, perhaps.

The remaining charges against three Duke University lacrosse players originally indicted for rape may be dropped sometime within the next few days, according to a report.

Inside Lacrosse Magazine writer Paul Caulfield told FOX News on Thursday that several sources have revealed to him that the assault and attempted kidnapping charges still pending against Collin Finnerty, 19, of Garden City, N.Y.; Dave Evans, 23, of Bethesda, Md.; and Reade Seligmann, 20, of Essex Falls, N.J., will soon be dropped.

Caulfield said his sources include more than just attorneys for the defense

There have been rumors that the families of Finnerty, Seligmann and Evans may be considering civil lawsuits against Nifong, Duke or the state if it turns out the accuser’s story doesn’t pan out and Nifong is found to be guilty of mishandling the case.

“This is something that will wait in the wings. Once the criminal case is dropped, we are going to see this and I believe we’ll see it quite quickly,” said Caulfield, a former prosecutor.

Megyn Kelly just updated this story on Fox News, saying that she’d spoken to the defense attorneys and they told her they hadn’t heard anything about it yet. However, she did confirm with another source that the accuser has been called in tomorrow for a chat with the new prosecutors. Maybe it’s their last ditch appeal to her to give them something, anything, to work with before they pull the plug.

The AG’s spokesman says they’re not planning any announcements for tomorrow, but news has a habit of breaking in this case on Friday afternoons.

You know what this calls for? Fred! (Old but gold.)

‘Bout time!

Why has it even taken this long?

I hope they do.

I have always hated people who sue the government because of mistakes and errors. I just feel not everything is perfect and we can’t sue for perfection.

But in this case, let the law suits flow…those kids have been so abused and unfairly treated that they need to have some compensation. The pain and heartache of the families, let alone the financial burden, needs to be compensated.

And while your at it, throw Nifong in the slammer with a jar of KY (maybe with a little sand mixed in).

right2bright on March 22, 2007 at 2:43 PM

So where do they go to get their reputation back?
Not to mention all their legal fees.

Iblis on March 22, 2007 at 2:45 PM

After the charges have been dropped, the three young men whose lives have been ruined by prosecutorial misconduct, wearing full lacrosse gear, should be allowed some quality time alone with Mike Nifong. And then sue the corrupt bastard in civil court.

ReubenJCogburn on March 22, 2007 at 2:53 PM

Yeah, unfortunately, the good news wagon, ends quickly.

amerpundit on March 22, 2007 at 3:02 PM

I hate when people sue the government for mistakes. However, this doesn’t exactly seem like a “mistake”. I hope they sue.

amerpundit on March 22, 2007 at 3:03 PM

I hope they sue that moron everyday for the rest of his life…his career is finished…maybe he can scrub floors at the ‘other’ college…

areseaoh on March 22, 2007 at 3:08 PM

I like what Fred had to say.

tormod on March 22, 2007 at 3:23 PM

I, like most, would like to see one of the most awesome bulti-million lawsuits ever. And teach a lesson to all prosecuters like him they will have major hell to pay.

auspatriotman on March 22, 2007 at 3:45 PM

These kids have real damages. They’ve been kicked out of school, had employment offers rescinded, mega legal expenses and had their reputations destroyed. I hope they bankrupt Durham! I hope they sue Duke too! I hope the bankrupt the whole darn place.

TheBigOldDog on March 22, 2007 at 3:56 PM

Its real scary when you get on the wrong side of government with no way to go. I hope they make an example of this yahoo, so other prosecuters will be more careful.

navy1946 on March 22, 2007 at 3:58 PM

I usually take the side that lawsuits are a major problem in todays society but in this case I’ll make an execption fo Nifong. I believe that there is clear misconduct on his part that requires civil remedy if not criminal charges.

Fred did say it best. I’d hope that when he’s elected President we could be treated to a series of these clear, simple common sense talks on problems confronting our nation. Not only do they really strike a chord with me but I have shared them with some of my more liberal friends and they appreciate them too.

Buzzy on March 22, 2007 at 4:07 PM

But the real question is will Amanda Marcotte finally apologize for slandering the lacrosse players as rapists?

/Bwahahahahahaha! Bwahahahahahahahaha! Bwahahaha….

tommy1 on March 22, 2007 at 4:54 PM

If true, it is long overdue. Of course in any lawsuit the state pays (not Nifong). However, maybe they should have to pay for leaving him in his position. Now if we could just get the guy in Travis County out.

duff65 on March 22, 2007 at 5:54 PM

Nifong should be sued indiviually….Include Duke, the professers who signed that ad in the newspaper, and also certain media outlets….they all will settle rather than go to trial with a jury…..

Nifong should also be disbarred for misconduct. as to the woman who made the charges if she had a shread of decency she would apologize.

robo on March 22, 2007 at 6:31 PM

There should be no lawsuit against the Prosecutor.

The fault lies with those who elected him.

Those who elected him are a distinct group of people compared to the Taxpayers, with some overlapping between the two groupings.

To sue the taxpayers, who did nothing wrong is a travesty.

I say send every registered voter a bill for their share of the damages.

What the Duke Case really illustrates is how our Judicial System has been corrupted beyond recognition by prosecutors that no longer answer to the Constitution they took an oath to protect and serve.

The Judicial System has been so corrupted that you are considered Guilty until you prove yourself innocent. If you have the money otherwise you are on your own. Prosecutors routinely hold press conferences to poison the Jury Pool and enhance their own careers rather than seek justice for the people that they serve.

Prosecutors make immunity deals with criminals to testify against defendants(suborning perjury) by eliminating or shortening their sentences or just pay them outright with money to get the testimony they need to convict defendants in a court of law.

Does the overzealous Johnny Sutton prosecution of Ramos and Compean come to mind? I urge HotAir readers to read Sue Bobs Diary and her piece on the Career Prosecutor regarding that above case. You will be shocked.

If you think I am over stating the state of our Judicial system, especially the prosecutorial misconduct that occurs on a daily basis, I urge you to read a series of articles published by the Pittsburgh Post-Gazette called Win at all Costs.

For those that are interested in the details of Mike Nifong and his prosecutorial abuses now numbering over 100 formal ethics charges, read William Andersons Michael B. Nifong and the Sociopathic State.

Mike Nifong should be disbarred and prosecuted for his handling of the Duke La Cross case and when the state gets done with him, I hope the family’s sue him so that he never has a penny left for his retirement.

ScottyDog on March 22, 2007 at 8:10 PM

This whole fiasco could have been stopped by the lying prostitute who started it all, Crystal Mangum. I say sue her a** off and get what you can. She claims to have nothing, but what she needs is a slap in the face from Lady Justice.

SouthernGent on March 22, 2007 at 9:20 PM

Are there criminal charges that could be brought against Nifong? It’s illegal to file a false police report; certainly somewhere in our legal code, it must be illegal for this injustice to occur.

Is “Inside Lacrosse” anything like “Obscure Sports Quarterly”?

The Unabrewer on March 22, 2007 at 10:49 PM

Here’s the set-up, let your imagination run wild on the punch-line.

Q: What do you call an ex-DA in jail?

A:

smellthecoffee on March 22, 2007 at 11:15 PM

Wendy, Wendy, oh Wendy? Where are you?

Bill C on March 22, 2007 at 11:43 PM

Bill C… Which Wendy are you referring to?

right2bright on March 22, 2007 at 2:43 PM

A successful suit might go a little ways towards restoring their reputations…

…but I bet this will follow them forever.

91Veteran on March 23, 2007 at 12:44 AM

I have been following this case for sometime now and I cannot believe that it has gone on as long as it has. Nifong should face criminal charges as well as several members of the Duke PD.

This is one case where I HOPE the FALSELY ACCUSED sue the living bejeezus out of EVERYONE that took the side of a liar. The liar ought to do some time as well.

Looking forward to this.

I don’t know, but I did see lacrosse coverage on the Ocho–right after the waterskiing squirrel.

ReubenJCogburn on March 23, 2007 at 3:40 AM

A law suit is in order here. But I believe one of the most culpable parties will never be named, MSM. Since this story was first reported MSM has WANTED it to be true. What’s juicier than a bunch of White Middle to Upper Class boys being responsible for the false imprisonment, rape and sodomy of an African American female? The story had “circulation” written all over it. America’s quest for dirt helped turn what should have been a fairly routine investigation into a three ring circus. Of course what would a circus be without clowns like Nifong? But we shouldn’t fret none if the charges are dropped, we still have the Anna Nicole Smith saga running 24/7. Another hard hitting news story.
