Breaking: Durham D.A. drops rape charges against Duke lacrosse players; Update: Press conference video added

But the kidnapping and sexual offense charges remain.
Joseph Cheshire and attorneys for the other players have said for months the woman told several different versions of the alleged assault.
Cheshire said Friday that the accuser now says she does not know if she was penetrated, which he said led District Attorney Mike Nifong to dismiss the rape charges.
I haven’t followed the case at all and was planning to ignore the news, but then I got an e-mail from the boss reminding me that the story was breaking. Hint hint.
And so here we are.
Have any of you followed this closely? All I know is that apparently DNA from a number of men was found inside the accuser after the attack; that none of it matches the defendants’; and that D.A. Nifong allegedly conspired to cover up that fact. Susan Estrich calls it an “extreme case of lawlessness by the prosecutors” that warrants Nifong being replaced by the court.
In other words, they’re being railroaded. Anything else I need to know?

Update: Betsy Newmark asks a good question — after all that’s happened, how does Nifong expect to prove the remaining charges beyond a reasonable doubt? Does he have smoking-gun evidence of kidnapping and sexual battery? If not, they’ll walk for sure.

Update: The defendants’ lawyers held a press conference late this afternoon. One of them addressed Nifong directly.

Update: The heat is on and Duke’s president is getting out of the kitchen: he’s called for Nifong’s resignation.

Whether you need to know or not, Nifong used this case to get re-elected, which makes it even more crass.
Also, while I don’t often agree with Susan Estrich, she is one of the more balanced, fair and likeable liberal personalities. She often points out the wrong, wherever the chips fall and doesn’t make excuses.

This has been a case of malicious prosecution from the get-go. Nifong violated established police procedure during the line-up when he didn’t put anyone in there who was known to be innocent. He further brought charges against one of the accused even though he had an airtight alibi, with ATM records to prove it.
These charges were brought solely on the word of the accuser by a malicious and opportunistic proscutor. Something to remember when thinking about the Lewis Libby case (where charges of perjury are leveled largely based on conflicting testimony) and the Haditha case, where charges are brought largely on the word of Iraqis who refuse to allow the bodies to be exhumed to provide physical evidence.
If there is any justice in this world, Nifong will be raped in prison someday.

From the various shows I’ve watched with legal talking heads (Napolitano, Greta, et al.), nobody seems to think this case will ever hold up and Nifong should at minimum be removed from the case.
Kidnapping charges? They’re got to be kidding. Whenever this case is resolved, and I have no doubt it will be in the defandant’s favor, I hope they’re able to seek damages against Nifong.
Sure, they were probably acting like punks at their party, but boorish fratboy hijinks do not mean their lives should be ruined by a overzealous prosecutor.

Is this Nifong’s strategy for retreat? Haggle his way out of the situation by making the defense bargain and fight to exhaustion for every step out, 1) drop rape charges; haggle haggle stall, then 2) drop kidnapping (what’s the definition of that? thought one had to be moved from point A to point B, at a minimum) haggle haggle stall, drop 3) sexual assault. Won’t that kick the can into 2050? What’s it called? Cooling?

The repercussions on this are going to be interesting. Expect to see Duke President Richard Brodhead offering his resignation soon. Alumni money may dry up if he doesn’t, and no president wants to see that happen under his watch.

I would like to hear from the poor lacrosse coach who lost his job over this mess. He was forced to resign from coaching one of the best lacrosse teams at one of the best schools in the country and it turns out it’s all for naught. That sucks, and I would be seething and cursing Nifong’s hatchet job.

It’s been crap from the get-go. Numerous problems in the exotic dancer’s original story, good alibis for several of the boys (including ATM receipts), pictures showing her bruised and intoxicated BEFORE the alleged rape took place, all of which ended up narrowing the window for the alleged, brutal gang rape to about 5-10 minutes, last time I remember.

I remember when this story was new she assumed the guys were guilty, now she’s listening to reason.

That stripper still owes those boys the 400 bucks she took from them for not putting on a show. But now that the news came out that she had several men’s semen in her, none of which belonged to those Lacrosse players, it could explain why when she danced it sounded like someone shaking a carton of egg nog.

This is an extreme case of prosecutorial misconduct. But such bad behavior is not as rare as we would like.
There was the bogus prosecution of Rolando Cruz in Illinois. In that case, the prosecutor (J. Michael Fitzsimmons) and several cops WERE put on trial, but were acquited by a jury that didn’t quite have the guts to send a bad prosecutor to prison.
Prosecutorial misconduct is commonplace in some jurisdictions, especially in Illinois.
I have personal knowledge of another case of prosecutorial misconduct in Lake County, IL in which my wife was defendant’s interrim counsel.
It started as a messy divorce where the woman accused her soon-to-be-ex of molesting their infant daughter. A “women’s advocacy group” picked up the accusation and pressed the States Attorney of Lake County to file 13 child molestation charges against the husband, despite the lack of evidence, just the wife’s word.
BTW, this tactic is referred to by some divorce attorneys as “deploying a tactical nuclear weapon” that is intended to blackmail the husband into giving the wife everything she wants. In this case the husband refused to knuckle so the wife made the accusation in divorce court proceedings.
After pressure from this “woman’s advocacy group” — representatives of whom attended each and every court hearing, as “support” for the wife — the States Attorney brought 13 indictments.
It took 6 years for the case to come to trial. One judge dismissed the case but “without prejudice” which meant the charges could be reinstated — which they were 8 months later after the “women’s advocacy group” threatened to publicly oppose the States Attorney in the next election. There was a jury trial, where the jury was out just long enough to fill out the jury verdict forms, and the defendent, my wife’s former client, was acquitted on all charges.
I would not be surprised that in the Duke case, another “woman’s advocacy group” is deeply involved in “supporting” the woman. Just because.
Nifong should be brought up on charges and prosecuted as well as permanently disbarred as an attorney. Hopefully, he’ll learn a new trade in prison.

I’d also add that I think that the city of Durham itself needs to be sued and forced pay a king’s ransom in compensatory and punitive damages for this. After all, they re-elected Nifong after knowing that this case was bogus. They were enablers of Nifong’s prosecutorial misconduct.

It was a very odd thing, like some kind of release that there was finally going to be a criminal prosecution that these white liberals could get behind.

I suppose that you can make your case that it is important to understand “what happened.” I wouldn’t disagree. But let’s face it, the so-called “criminal justice” system in the United States is totally disfunctional and flat-out broken. I am MORE interested in hearing people’s ideas on how to fix it. Are there any lawyers that post here that can confirm a suspicion of mine? I’m thinking that the rape charge was dropped in order to keep the DNA report out of an eventual trial (assuming Nifong doesn’t drop all of the charges). If there is no charge that the players vaginally penetrated her, the DNA report would seem to not be relevant. That of course assumes that shield laws are still in effect without an actual charge of rape.

Unfortunately, Nifong can’t be prosecuted criminally.As a D.A., he has some kind immunity, per Fox News legal analyst Kimberly Guilfoyle. I caught a portion of her show last weekend so i didn’t get all the information but I think she said he could be disbarred and sued in a civil action.

I lived in Durham when this lie started (have sinced moved to Raleigh). I can tell you that MKH has it exactly right. The Durham liberals LOVE to be chastised by blacks. It’s the whole White guilt thing, ya know!

Resignation of Nifong? How about one of those good, old-fashioned civil rights lawsuits? Amazing that those laws sometimes work for folks not in an pre-ordained victim class. Lawsuits against the State, disbarment (and possibly a little time in the gray bar hotel) for Nifong, and a cold slap in the face for those so willing to believe this obvious political stunt would make me feel a little better.
As for the university president, does anyone not know of one with cranial/rectal juxtaposition these days?

President Brodhead is in hiding, all of a sudden the universtity has found a use for a Christmas Holiday. Nifong releases this on a Christmas Holiday. They have finally found a use to celebrate Christmas.

Most of us here in NC knew this was a farce within weeks of the “investigation”. We are not being played for patsies. That would infer that Black people do not know any better. Black people do know better, but a great many of us are complicit in perpetuating the disadvantaged/victim dogma. Moving away from that and admitting the truth would mean having to collectively acknowledge afore mentioned complicity; Black people would have to admit that being able to make excuses and blame whites was more important than actually succeeding in life….(a big reason why Black conservatives are so vehemenantly fought against by any and all means especially by the Black community) That is the lynchpin that holds that dogma in place. Variables: number of players who might sue, lawyer’s fees, defensive advertizing costs … all sorts of inputs.

1- Before this “strpper” falsely accused her clients of raping her, she should’ve douched so the semen of her 6 boyfriends would not have shown up on the DNA analyses.

What is the status of the two current students who remain under indictment? I understand that they were suspended from the school when they were indicted. Is that true? If so, on what legal grounds did Duke University base the suspensions? Isn’t one still considered innocent until proven guilty, since indictment is not the same as a verdict? They weren’t allowed to continue their studies, for which they had paid? And if the grounds for suspension include trashy and tastless frat house partying, wouldn’t all the other frat party-goers have to be suspended for that, too? Duke University has a Law School for crying out loud. Are they providing pro-bono legal defense to their underclassmen or are they so corrupted by Leftie Theology, they are crafting arguments for the prosecution? On what side was Duke U Law School in the Military JAG recruitment on law school campuses? James Taranto noticed that only George Mason University Law School was on the winning side of the decision, with a couple dozen once prestigious law schools all on the losing side. Was Duke one of them, too?

Well, checked FAIR’s (Forum for Academic and Institutional Rights) listing of schools that opposed military recruitment and Duke is not listed. However, it’s not a complete list, it’s only of the schools that were willing to be publicly identified. There are other schools that didn’t want their names listed publicly, so have to find out by other means whether Duke was one of those schools or not.

If the students are guilty, I want them expelled. Sweeties, that won’t be a problem, they’ll be in prison.
I’m beginning to believe that the state of US universities is such that they have become simply wealth-takers, not wealth-makers, charging outrageous tuitions, and delivering a worthless product. You can’t take that luxurious food court or student union with you, only the degree - and the taste for luxuries, which you won’t be able to afford thru your next four jobs.

It’s archived by Google actually, and a few other people. It looks weird (fonts)because they converted the .pdf into a web page.
I think the quotes are phony - at least the ones that are coherent. They remind of some of the quotes from a certain controversial 9/11 memorial.
I think there is some leftie “rent-a quote” think tank out there. In this case, I think they got some quotes wrong - although the we can’t think part is dead-on;

You’re not the only one who thinks so - the service academies are getting applications at rate of ten for every available slot - and that’s hard work just to apply, with the kind of recommendations they require, not to mention the SAT combined scores they want to see. I mentioned earlier today, two private men’s colleges that are holding up just fine: Hampden-Sydney and Wabash.

I thought the fonts were deliberate - making their point in a visual kind of way. Too influenced by advertizing gimmicks. “But worse, I wonder now about everything …If something like this happens to me …What would be used against me - my clothing? Where I was?”
Now that quote was right on the money; it was such a random thing could happen to anyone, anytime, anyplace … don’t lots of women out there rent themselves out to frat parties as strippers, show up plastered and then have to retract every accusation because their own clothes testify against them? So, so … unknowable!

The treatment of these white-skinned men has been bad enough. Imagine how much more frequent such cases will be, and how much worse their outcomes, as the Americans’ envied, hated majority becomes an envied, hated minority.

NOT TRUE!
18 USC 242, “Deprivation of rights under color of law” provides criminal penalties for malicious prosecution, including 1 year in federal prison. Willful witholding of evidence (the DNA) is a willful violation of the Sixth Amendmentment (”to have compulsory process for obtaining witnesses in his favor”) ought to qualify in my uninformed opinon.
The punishment for a “color of law” violation is a find and up to 1 year in prison, provided no bodily injury has occurred as a result. Then penalty can include death if a homicide was the result of the “color of law” violation.
