[...] If Bush dispensed with tribunals altogether and ordered the Gitmo gang held without trial for the duration of the WoT as prisoners of war, arguably that would be constitutional. As it is, if he wants tribunals, he has to go to Congress and get explicit approval. (A point which Breyer’s two-paragraph concurrence on page 82 makes clear.) Think Progress notes, correctly, that the Court’s unwillingness to read implicit grants of power into the AUMF might mean the end of the NSA warrantless wiretapping program, which Gonzales has said is based on that very statute. (Stevens addresses the AUMF on the bottom of page 37, saying that if Congress wants to make special wartime exceptions to standard legal procedures, it has to be specific.) The NSA point is probably moot, though: Arlen Specter told Chris Wallace on Fox News Sunday that Bush was already leaning towards submitting the program to the FISA courts, and now that this has come down, his hand will probably be forced. I doubt Think Progress’s point will ever be adjudicated, and if it is, the case is likely to be decided on constitutional (read: Fourth Amendment) grounds, not the specificity of the AUMF.
I noticed that Specter could not get a quorum for the scheduled judicary meeting on Friday. He was visibly upset, only one republican showed (Jon Kyle) to report the results of subcommittee meeting on internal immigration enforcement. In fact, he, Specter, threatened missing members with replacement. Word has it on the Hill that the republican leadership is looking to replace Specter during the 4th of July recess.

Specter has really crossed to the dark side I think. His nonchalance about NYT exposures of Nat'l security is scary.

I've made my opinion clear elsewhere on Hotair, that the management and reporters involved in printing national security secrets must be prosecuted.

Rep. Peter King is absolutely right.

The sooner, the better.

Traitor/treasonous congressmen, MSM, ACLU, National Education Association, CAIR, locked down and locked up. If thie administration and courts can’t do it, then lets organize a 10,000 strong citizen’s arrest

Strong medicine CountryDoc. Unfortunately it would probably play into the hands of the enemy within. Imagine the outrage in the domestic enemy press and their comrades in the foreign enemy press if 10,000 armed free Americans took action! Make no mistake about it, we would need to be acting as the militia to bring about such arrests. Don't think for a minute that CAIR and their ilk don't have armed mercenaries to protect them.

Of course, the administration would be forced to put down such an "insurrection" if free citizens did the job the government doesn't appear to desire to do. Calls by the criminals and tyrants at the UN would escalate to have our right to arms curtailed or destroyed. They would bring their massive propaganda outlets together to demonize our citizens. We might even see confiscations of weapons to "protect" us from "radical rednecks who only want blood of international humanitarians."

Yeah, forget it. Nothing so richly deserved will happen to those who hate this country, yet demand to lead it.

C'mon senators, Congressmen, act now. Charge them for treason, but I think the majority of the country will stand behind Bush and the troops. Track the phone calls, follow the trail. Get the leakers and the editors who ignored Bush. Put them in holding camps until the war is over. If we get enough of these democommies behind bars waiting for the war to be over, they'll start supporting the Powell doctrine again.

We need:
1. Traitor/treasonous congressmen, MSM, ACLU, National Education Association, CAIR, locked down and locked up. If thie administration and courts can't do it, then lets organize a 10,000 strong citizen's arrest
2. Immigration laws enforced and illegal immigrants "redeployed" back to Mexico, Saudi Arabia, Guatamala, Cuba, China, Iran, Russia, and France.
3. Borders locked down
4. End health care, disability, ADC, free legal counsel, and citizenship by birth or marriage for all immigrants. Don't even think about letting them vote or have drivers licenses.
5. Begin training our children again on the REAL history of this country, principles of unity and democracy with the priorities of a functional government having higher priority over winning political battles.
6. Investigation to terrorist money links to the Sulzberger family. I feel sure they got grant money from Al-Jazeera :)

IMHO, this is not about Spector. We know what we Americans can expect from this linguini spined wanna be conservative [and that is not very much], but the debate must be about securing the interests of America. No way we can count on The Sphincter for that.

Here we have a New York representative in our congress calling for the prosecution of the Traitorous Times for crimes committed against your, mine, and Americas best interests. Now is the time to fish, or cut bait. The rest is just mental masturbation.

Remember 9-11? Wake Up America! Your future is on the line.

I watched his interview / debate twice today, God gave me the strength to keep from drop kicking my TV through the window each time that idiot Spector opened his mouth. King and Tancredo would make a good pair in '08.

Kudos to King for his comments on the treasonous acts of the NYT. He is also dead right on immigration. Spector's remarks defending the indefensible show he should be stripped of the chairmanship of the Judiciary Committee.

If the Administration does not immediately open an investigation of the NYT for violating security laws with the purpose of vigorous prosecution, Congress should launch its own investigation as it is the American people and not just the Bush Administration that has been endangered by the treason committed by the NYT.

Spector can talk for five minutes and say nothing. What is this political eunuch doing in the Republican party?

I just had the realization that in the war that the NYT, Murtha, etc are waging against GWB, the potential collateral damage is ,well,us and our families. They do not give one whit about having a bunch of us killed to prove their little point.Which is a lie at the root anyway, they just lust for power pure and simple.

The support for Spector, edge thin as it was, came from those who voted in the primary. When the GOP has the executive it will not, as a matter of principle, seek to defeat its own Senators. The problem, as always, lies with the voters.
