This prosecutor needed “a way out” of the dilema he found himself in – er – put himself in. I think Rush is being overly generous giving this twerp a chance to “save face” with his political hack buddies. I do understand Rush’s need to get out from under the stress, though. He knows it’s political and doesn’t mean squat to his credibility.

Let’s hope Delay doesn’t cut Ron Earle any such slack. Earle is a proven political hack that set out to get him. In Rush’s case, I believe the State Attorney was just an opportunist.

As far as the press coverage goes, is anybody really surprised? It just gives me another example to show my children about how the media twists information to fit their agendas.

Now I know he demonstrates absurdity by being absurd, and I realize he pronounces poor “the poo-er” just to irritate people on purpose,(actually, it IS funny) but it appears, at least to me, that he has a reflexive indifference toward them. I truly can’t blame him, because so many of the poor are invincibly ignorant Dims, and deserve no better than what they give, and I can’t pin down an exact instance where he really struck me as antipathetic,(is that a word?).

It’s more like a gut feeling I get from a thousand vague comments he’s made. It’s the only gripe I have with Rush, and I have been a dittohead since the first time I heard him almost 15 years ago. He’s brilliant, insightful, funny as hell, and above all… Right. I also appreciate the concept of tough love. It’s fair, and it works extremely well. I acknowledge the charity of Rush, (the funds he raised for cancer research Friday was a beautiful, real gesture) and he could not do what he does as well as he does if he wasn’t genuine. He is a great one, there’s no denying it.

I just can’t shake the feeling though. Of course, I could be mistaken… or I may have some subconscious class envy myself.

The DA ordered his henchmen to swoop down and take Rush’s medical records WITHOUT court approval and to violate doctor/patient relationships. Rush’s attorney argued this point, but even though the judge agreed with Rush’s attorney, he still said it was OK to bend the rules this time.

Now, there are certain exceptions to the rules which law enforcement can utilize during criminal investigations without first obtaining a warrant. These are called extigent circumstances:

1) Plain view-where the police clearly see illegal stuff in actual plain view.
2) Consent-where the owner of property allows police to search his stuff.
3) Emergency situations(plain view only).
4) Preservation of Evidence-this is where the police witness evidence being moved or destroyed and can move without a warrant and gather up evidence, or REASONABLY believe that evidence is about to be destroyed.
5) Hot pursuit.
6) Incident to LAWFUL arrest (vehicles and persons searches).
7) Prisoners.

Now, I AM NOT AN ATTORNEY, so I will stand corrected by any legally trained person if need be. Now, none of this stuff applies to Rush’s situation.

I think that where Rush now resides is hard core Dems including the judges and the DA. Rush is perceived as a threat to them, and they want revenge because Al Gore did not win the election, because Kerry did not win the election, because they are not able to set up someone in broadcasting that can rival and surpass Rush. For the lib/dems, Rush is a reactionary! So, as stated in my copy of the COMMUNIST MANIFESTO AND RESTAURANT GUIDE “The ends justify the means.”

I think that Rush should have perhaps challenged this stuff via the Florida court of appeals and request the Florida State Attorney General’s to investigate the DA who went after Rush.

Could it be that, perhaps, in some states, the Constitution and Criminal Court procedure is indeed…written in pencil?

Rush is lucky in that he can afford rehab. Most cannot. Like many addictions (tobacco comes to mind) it often takes several attempts to finally kick a drug habit.

If drug addicts want to ruin their lives, that’s their business. If they want to kick the habit, it behooves us to help. However, let’s eliminate the ancillary crime (burglary, robbery, etc.) that results from the high costs of the addiction and the rehab – and keep innocent citizens out of it.

If we can learn from this, then Rush’s experience can be a net benefit for all.

Uh huh. You can bet on it, gr. Rush is too big a fish to let go. They’ll try something, but I think MahaRushie will outwit them.

My personal take on all this is that the dim prosecutor knew he really had nothing he could pin on him, and would not be able to use the copies of his medical records he made to railroad him, so he came up with this diversion plan so he can have this whole thing hang over Rush’s head for 18 months. That idiot is probably bragging to all his dim friends that he “owns” Rush now. You watch, somewhere someone will try accusing Rush of something to try and get him in trouble and violate his diversion.

BTW he may have reported to police on his own, but only by the most technical of readings was he “arrested.” They just want the headline to make it appeara that the police tracked him down and cuffed him like a common criminal and took him away to jail. A pox on the press!
